CONTRACT
This document shall represent a non-binding agreement between the
party of the first part, hereafter referred to as the cache owner,
and the party of the second part and all parties thereafter,
henceforth known as the seekers and/or finders, to be contingent
upon such categorization as set forth below. The cache owner shall
hide and maintain a geocache as set forth by the parameters listed
below for subsequent parties to attempt to locate. Owner retains
all rights with respect to said container, items contained therein
and online representation of this Contract.
SECTION 1. GEOCACHE HIDE
The cache owner agrees to hide a suitably sized container in a
publicly accessible location. Every reasonable attempt shall be
made to conform to guidelines as set forth in Appendix A.
Geocache shall be a regular sized container as defined on listing
service at geocaching.com. Said geocache will not be an event cache
in which case all parties would attend and partake in a party
planned by the party of the first part. The party of the first part
will not be a party to such a party. No such party or parties will
take place in connection with this listing with the exception of
parties organized by third parties for the express purpose of
hunting this geocache for which the owner will not be responsible
in part or otherwise.
- Container shall not exceed volume of one third (1/3) of a
firkin so as not to be defined as “large,” nor shall it
fall below a minimum of 842 milliliters so as to avoid being
classified as “small.” Container shall be painted in a
suitable method so as to be camouflaged in the natural
surroundings.
- Container shall not be rendered invisible. All applicable laws
of physics shall be conformed to as far as practicable.
a) Container may be disguised in a
manner to blend in with surroundings, i.e. painted to resemble
another object suitable to the location and/or theme of said
geocache placement as per Paragraph 6.
b) Container may be covered in materials either natural or
unnatural to the location in an attempt to disguise said container.
Materials could include but shall not be limited to: sticks, rocks,
leaves, logs, mulch, trees, vegetation, woodchucks, shrews and
harpies.
i. No animals shall be harmed in the
placement of said camouflage.
ii. Even if they really deserve it.
Maintenance: Cache owner agrees to make reasonable efforts to keep
the container in place and replace if missing. Attempts will also
be made to ensure that said container remains in acceptable
functional condition and contains a respectable amount of trade
items as set forth in paragraph 4 of Section 1.
- Should container be missing as defined herewith:
a) gone
b) not there
c) stolen
d) somewhere else
e) in absentia
then geocache listing will be temporarily disabled until a suitable
replacement container as set forth in Section 1 paragraph 2 can be
procured, decorated, filled with items as defined below and
replaced in the same or another appropriate location.
- Cache owner reserves the right to replace said container in a
new location at any time, provided the new location is updated in
the Contract. Should such action become necessary it is incumbent
upon the seekers of said geocache container to read the Contract
again lest they fail to find said container.
- Owner will not be held responsible in any way for failure to
find associated container due to failure of seeker to read or
comprehend Contract.
- Owner shall maintain Contract in accordance with guidelines as
set forth in appendix A including description, hints and online
logs.
a) No hints shall be given.
Trade Items: Container shall contain suitable items for trade.
Trade items shall include a variety of items including but not
limited to:
- stuff
- trackable items
- other stuff
Owner assumes no responsibility for
quality of trade items at any time during the lifespan of the
geocache. Reasonable effort shall be made upon initial placement to
include items appropriate to the theme of said geocache.
Logbook: Container will contain a logbook suitable for writing
logs. A writing implement shall be included in the container for
inscribing prescribed logs.
- Logbook shall consist of appropriate notebook consisting of
lined paper with a minimum of thirty-seven (37) pages. Prima facie
resemblance of cover in closed position to legal pad is strictly
due to the interpretation of cache finder as defined in Section 3
and is not due to any attempt by cache owner to be
“funny” in any way. Cache owner will not be held
responsible for humor found or unfound in any part of logbook.
- Cache owner subsumes no responsibility for functionality of
said writing implement(s). Writing implement(s) shall be included
upon initial placement and inspected upon each visit for the
express purpose of maintaining said geocache.
a) Said implement, if pen, is assumed
to be in working order upon placement but may be subject to the
following conditions.
i. out of ink
ii. frozen
iii. broken
iv. leaking
v. otherwise incapacitated
b) If implement is pencil then sharpener may be included. Cache
finders as defined in Section 3 shall be responsible for
maintenance of said pencil for themselves but not for all
subsequent finders.
- Should finders not find or have suitable implement to mark
logbook they shall make a reasonable effort to mark log using other
fashion as set forth in Section 3, paragraph 2, subsection 1.
Container: Upon initial placement container shall be a regulation
metal ammunition container known to hold ammunition measuring 30mm
in width. Exterior of can shall be painted in a method so as to
simulate appearance as another object more commonly associated with
theme of said geocache placement in its entirety. To wit:
a) Can shall be sprayed with minimum
of three (3) coats of various solvent based aerosol coatings to
alter appearance.
b) Can may resemble fine Corinthian leather, but any resemblance to
a container designed to hold and transport documents is strictly up
to the interpretation of finders as per Section 1, Paragraph
5.1.
c) Can shall be locked. Lock shall contain minimum of three (3)
rotating dials that shall be maneuvered to open said device
allowing access to items contained as per paragraphs 4 and 5 of
this section.
SECTION 2. GEOCACHE SEEKING RESPONSIBILITIES
Cache seekers shall make every reasonable attempt to find said
geocache and log their find online on the appropriate geocache
listing page. It is assumed that anyone attempting to locate said
container will have read and attempt in all cases to comply with
the disclaimer as set forth in Appendix B. Cache owner is no way
responsible for failure of seekers to take necessary precautions as
to safety as set forth in Appendix B. Owner will not be held
responsible in any way for failure to find or open associated
container due to failure of seeker to read or comprehend Contract.
Seeker may deposit vehicular transportion device at or near
published location on listing service for purposes of seeking said
container provided compliance with all local regulations is
observed. Container shall be located in end of log at Universal
Transverse Mercator coordinates numbering easting four zero nine
eight seven eight. The northing coordinates shall be four six eight
one zero seven three. After seekers locate the container they shall
be categorized as finders and proceed to the instructions located
in Section 3.
SECTION 3. GEOCACHE FINDING
Upon location of container all finders shall be required to open
said container. Container shall be secured as per Section 1,
paragraph 6(c). Information required to open device used to secure
said container shall be one (1) of two (2) three (3) digit numbers
signifying the minute portion of coordinates of Contract as
published on listing service. Finder shall rotate alphanumeric
dials as prescribed until in alignment with line on said device to
open securing device. Upon completion of all subsequent steps in
Section 3 finder shall replace device as found and reset all dials
to sequence other than that required to open said device. Container
shall be returned to original location as found. Failure to comply
with all paragraphs in Section 3 may render finder’s claim
invalid and subject to ipso facto deletion by owner.
Cache contents: Finders shall deal with contents of container
according the manner prescribed below.
- Container shall include a logbook as proscribed above in
Section 1, paragraph 5. Finders shall remove logbook from container
and, at a minimum, make a mark known to represent them on a page in
said logbook. Marks acceptable shall include but not be limited
to:
a) signature of online geocaching
account
b) signature of name
c) stamp
d) other representative picture or pictograph
e) pseudonym
f) nom de guerre
g) X
h) aka
i) blood sample
- Finders are encouraged to notate other information in the
logbook and shall not be limited to signature only.
- Upon completion of above task by all members of the party the
logbook shall be deposited and sealed in water resistant device and
replaced in main container, said device to be provided by cache
owner. Should device fail another may be provided ex gratia by
finder which will be appreciated by owner.
Trade items: Items other than logbook and writing implements
contained in the container are intended as items to trade. It is
not necessary to trade items but the following restrictions shall
be adhered to in the event such trade shall take place.
- Each item taken shall be replaced with an item of comparable
value. Items suitable for trade shall include but not be limited
to:
a) Trinkets
b) toys
c) McToys
d) fobs
e) doo-dads
f) local currency
g) useful items
h) money
i) stuff you found while walking from your car
- Items that are inappropriate to leave as trade items include
but shall not be limited to as per Appendix A:
a) food or food type items
b) explosives, fireworks, ammo, lighters, knives (including pocket
knives and multi-tools), drugs, alcohol or other illicit material,
blah blah blah ad infinitum
c) stuff I don’t need
d) livestock
e) junk
- Items known as trackable items as defined in Section 3,
Paragraph 4 shall not be included in this category and are subject
to their own regulations as defined in that Paragraph.
Trackable items: Trackable items shall be properly logged in and
out of the cache listing as per customary practices indicated by
Appendix C. Items collectively known as “trackables”
shall include but not be limited to:
a) travel bug dog tags and their associated items
b) geocoins
c) pathtags
d) properly tagged and tracked wildlife as per Sec1. Para 2(b)i as
above if in compliance with all local laws and regulations.
Online logs: Upon agreement of Contract and completion of the tasks
forthwith finders may append online Contract indicating their
status as having “found” the container. Finders are
encouraged, but not required, to write a log detailing their
experience and enjoyment of said experience insofar as said details
shall conform to Sec 1, paragraph 3, subsection 4(a). Owner retains
exclusive right to terminate Contract with respect to future
completions at any time. Upon termination all previously submitted
logs indicating completion of Contract shall not be rendered
void.
