Will of John Sheer, dated 1 January 1835
In the Name of God Amen This Writing contains the last Will and Testament of me John Sheer of the Parish of Davidstow in the County of Cornwall yeoman And first I give unto my wife Mary Sheer the sum of Three pounds per year and every year until six months after the death of Precilla Marshall who is a life on my Estate that Edward French occupies of my land in Downinney in the parish of Warbstow I also order that my wife shall have her sole maintenance of my son John Sheer at Trenanick and be at liberty to take and use all things for her own consumption without the denial of my son John Sheer his heirs or assigns until six months after the death of the said Precilla Marshall aforesaid and six months after the death of Precilla Marshall I then give unto my wife the sum of Fourteen Pounds per year and every year during her natural life to be paid out of my Estates of Land in Downinney aforesaid my wife annuity to be paid in equal quarterly payments with power to distrain for nonpayment when my wife’s annuity of Fourteen pounds per year takes place the three pounds above mentioned will immediately cease Also I give unto my wife my best bed performed to be delivered to her immediately after my decease but if my wife shall at any time be married again then her annuity of Three pounds per year or Fourteen pounds per year shall be immediately cut off The above annuities are in lieu of Dower Also I give unto my Son in Law Richard Bailey the sum of One shilling to be paid in one month after my decease but my will is that my said Son in Law Richard Bailey shall never interfere in the slightest degree with his wifes annuity hereinafter given for I hereby order my Guardian in Trust hereinafter named to receive and manage the said annuity for the sole benefit of my daughter Elizabeth Bailey And I give unto my aforesaid daughter Elizabeth Bailey the sum of Ten pounds per year and every year during her natural life to commence after the death of Precilla Marshall that is to say my will is that my said daughter Elizabeth’s annuity shall not become payable until the end of two years after the death of the said Precilla Marshall when the first years annuity will become payable and I bind my Estates of Land with the payment of this annuity that is my land in Downinney aforesaid and this annuity shall be paid in equal quarterly payments Also I name and direct that my son John Sheer shall build a house at Trenanick for the residence of my daughter Elizabeth Bailey and my wife Mary Sheer for their sole use and benefit during their natural lifes and I order that this building shall be completely finished by Lady day next Also I give unto my daughter Mary Robins the sum of Twenty two pounds per year to be paid and continue for the full time and term of ten years from the time of my decease to be paid out of my Estate of Hallworthy in the Parish of Davidstow by my Son in Law George Robins the first payment to become due at the end of one year after my decease Also I give unto my Son in Law George Robins all my Estate of land at Hallworthy in the Parish of Davidstow and to him and his heirs for ever subject to the payment of the yearly sum of Twenty two pounds for the full term and time of ten years as aforesaid Also I give unto my daughter Mary Robins the sum of Fifty pounds to be paid to be paid by my Executor in twelve months after my decease Also I give unto my daughter Mary Robins the sum of Eighty pounds to be paid in three years after my decease by my Executor Also I give unto my son John Sheer all my Estate of land called Trenanick and my Estates of land called Downinney both in the parish of Warbstow and my Estate of land called Little Trebeak in the parish of Treneglos Also my leasehold Estate called Kennecott Hill Head in the parish of Poundstock the land of Trenanick and Downinney to him and his heirs for ever subject to the maintenance of his mother and all other matters and things specified in this Will Be it minded that my will is that my Son in Law George Robins shall pay and discharge the Mortgage and Interest on my Estate at Hallworthy and incumbrances whatsoever on that Estate (this will continue from the other side) And I hereby nominate and appoint John Dinnes of Tredidon in the parish of St Thomas by Launceston in the County of Cornwall and George Dinnes of Webworthy in the parish of North Petherwin in the County of Devon yeoman to be my Guardians in Trust to have the management of all matters and things contained in this Will and particularly to receive my daughter Elizabeth Baileys annuity aforesaid for her sole benefit All the rest residue and remainder of my Estates Goods Chattels and Effects not hereinbefore given both real and personal of whatsoever name or nature or wheresoever I give and bequeath unto my son John Sheer whom I also constitute nominate and appoint the whole and sole Executor of this my last Will and Testament by him freely to be possessed and enjoyed and I hereby revoke disallow and disannul all and every other Will Legacy or Bequest ratifying and confirming this and no other to be my last Will and Testament In witness whereof I have hereunto set my hand and seal this first day of January in the year of our Lord One thousand eight hundred and thirty five
