- The Housing of Soldiers
No soldier shall, in time of peace, be quartered in any house without the consent of the owner, nor in time of war but in a manner to be prescribed by law.

The Third Amendment seems to have no direct constitutional relevance at present. It is the least litigated amendment in the Bill of Rights and the Supreme Court has never decided a case on the basis of it.
War-making activity is the duty of the government only, but this essential power is not unlimited. Government has to respect that our homes are our property and these may not be overtaken by the military during peace-time and during war except in a legal manner determined by Congress.
Even though the federal government today is not likely to ask people to house soldiers in their homes, even in time of war, the amendment still has some modern implications. It protects the individual’s right of domestic privacy and states that people are protected from governmental intrusion into their homes. It is the only part of the Constitution that deals directly with the relationship between the rights of individuals and the military in both peace and war—rights that emphasize the importance of civilian control over the armed forces.
