Terms and Conditions
- These terms and conditions ("Rules") apply to the promotion to be conducted by Garmin (Europe) Ltd. during its geocaching campaign launched in partnership with geocaching.com which will take place from June 27, 2009 until September 26, 2009 (the "Promotion"). By entering the Promotion, you agree fully and unconditionally to be bound by these Rules and the decisions of Garmin. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to the Promotion, the decision of Garmin shall be final and no correspondence or discussion shall be entered into.
- The Promotion Promoter is Garmin (Europe) Ltd of Liberty House, Hounsdown Business Park, Southampton, Hampshire, SO40 9LR. No purchase is necessary to enter or win this Promotion. Making a purchase will not increase your chances of winning. There are selected geocaches in the counties of England, Ireland, Wales and Scotland which have been selected by Garmin. In order to enter you must select the geocache you want to find, physically locate the geocache and take a photo of the area that the geocache is placed in. You will then have to upload your image/s (1 image per geocache site) to the website and be required to answer all the questions posed an provide all the information requested in the online entry form and provide your first and last name, mailing address, email address, date of birth and daytime phone number. All participants will then vote on the best photos to determine a weekly winner, there will be 12 weekly finalists. Garmin will pick 1 grand prize winner from the 12 weekly finalists.
- This Promotion is open to UK and Ireland residents only. All participants must be 18 years of age or over to be eligible for this Promotion. Employees and close family of Garmin or of Frontier Travel and of the partner companies involved are not eligible.
- One (1) photo entry per geocache per person only is permitted. Any attempt by any participant to obtain more than one Promotion entry by using multiple/different e-mail addresses, identities, logins, or any other methods will void that participant's entry and result in his/her disqualification from the Promotion.
- By entering the Promotion, the entrant hereby warrants that all information submitted is true, current and complete. Garmin reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these Rules. In the event that the randomly chosen Promotion winner is found to subsequently found to be ineligible for the Promotion per these Rules, Garmin will disqualify the winner and will randomly select a replacement Promotion winner from all remaining eligible entries.
- Any information submitted by the entrant must be personal to and relate specifically to the entrant. The entrant hereby warrants that the information, which is submitted and/or distributed, will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Garmin reserves the right, but not the obligation, to screen, filter and/or monitor information provided by the entrant and to edit, refuse to distribute or remove the same.
- PRIZE: Garmin will give away the grand prize of 1 x Holiday to Newfoundland Canada valid between 1st April – 31st October 2010 at a value of £3,500 and 12 x Oregon 550 at a value of £429.99.
Details of grand prize: One prize holiday is offered, valid only for 2 adults travelling together, and is valid only for travel between 1st April – 31st October 2010, subject to availability and certain travel restrictions which will be notified to the winner. Responsibility cannot be accepted for lost or mislaid entries or for inability to contact winner. The promoters are not responsible for any delay or cancellation of any element of the prize or for any inability of the prizewinner or their guest to take up the prize. The prize provided by Frontier Travel includes return flights for 2 people from London to St. John's, Newfoundland in Economy class; 8 days car hire, seven nights' accommodation as per the itinerary, based on 2 adults sharing a room on a room only basis. All additional room costs, expenses, meals and incidentals to be settled by prizewinner. All bookings are subject to availability. Prize excludes travel to departure airport in the UK. No stopovers or route changes are permitted. Any income tax liability incurred in connection with the flight tickets is the prizewinner's responsibility. Any travel in addition to the prize itinerary will be at prizewinners cost. Travel insurance, passports and any required Visas are not included in the prize but are a requirement of booking the holiday and must be obtained by the winner prior to travel. The Promotion prizes are non-transferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Garmin, who reserves the right to substitute the Promotion prizes with another prize of equal or greater value if the Promotion prizes are not available for any reason as determined by Garmin in its sole discretion. The winner is responsible for paying all taxes associated with receipt of the Prize.
- Except where prohibited by law, the winners may be required to take part in or co-operate with publicity. Participation in the Promotion constitutes the winner's consent to Garmin's use of winners' name, likeness, personal photograph, submitted contest photograph(s) and city of residence for promotional purposes without further payment or consideration.
- The winners will be informed directly by e-mail or phone by Frontier Travel. If a winner of a Prize cannot be located or does not respond within seven (7) business days of contact from Frontier Travel, the Prize will automatically be forfeited and an alternate potential winner will be drawn from the pool of remaining valid entries. For a complete list of the winners' names and cities of residence, please send a stamped self addressed envelope to Garmin Marketing, Garmin (Europe) Ltd of Liberty House, Hounsdown Business Park, Southampton, Hampshire, SO40 9LR before December 31, 2009.
- Participants agree that any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys' fees; and participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of the Promotion, entrant's rights and obligations, or the rights and obligations of Garmin in connection with the Promotion and the terms and conditions of this agreement will be governed and construes in accordance with the laws of England and Wales.
- Garmin will not pass your personal details to any other organisation without your permission, except for the other partner companies involved in the prizes (Groundspeak Inc. (dba Geocaching.com), Frontier Travel) for purpose of awarding your prize if necessary, to which you expressly agree by entering the Promotion.
- Garmin is not responsible for late, lost, incomplete, or misdirected entries or communications or for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, internet service providers, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Garmin is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. Garmin reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotions to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Garmin reserves the right to seek damages from any such person to the fullest extent permitted by law. Garmin's failure to enforce any of these terms shall not constitute a waiver of that provision.
Frontier Travel

Entrants will be asked to complete their details online to qualify for entry into the prize draw. Winners' details (name and county) will be published on geocaching.com/garminphoto website from September 26th 2009. Closing date for entries is September 13th 2009. Winners will be notified in writing and by telephone. One prize holiday is offered, valid only for 2 adults travelling together, and is valid only for travel between 1st April – 31st October 2010, subject to availability and certain travel restrictions which will be advised to the winner. Responsibility cannot be accepted for lost or mislaid entries or for inability to contact winner. Judges decision will be final and no correspondence will be entered into. In the event of unforeseen circumstances the promoter reserves the right to offer an alternative prize, of equal or greater value, at the promoters discretion, no cash alternative will be offered in whole or part and the holiday prize cannot be refunded, upgraded, exchanged or transferred. The promoters are not responsible for any delay or cancellation of any element of the prize or for any inability of the prizewinner or their guest to take up the prize. Winners may be required to participate in publicity. All prize holiday elements are subject to general terms and conditions of Contract relating to Frontier Travel, the holiday organizer.
