LavaLizard: Although the cache appears to have been placed in a public easement and although such placements usually do not cause problems, it is been our experience that battling a land-owner in this sort of circumstance is always a losing battle for the cache owner. (It is for this reason that we recommend getting the permission of any/all nearby property owners when placing a cache within a residential neighborhood. )
To prevent any further incidents, I am archiving this cache listing to remove it from search pages.
