OFFICIAL RULES
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
All PARTICIPANTS participate at their own risk and liability.
4a. To participate in the Social Media Sweepstakes, entrants must first:
(1) Follow @wildbasinhardseltzer on Twitter, Instagram, and/or Facebook;
(2) Have an account on Geocaching.com; to register for an account with Geocaching.com, visit www.geocaching.com/account/register and follow the directions on the website to create a free account and,
(3) Have a Twitter, Instagram, and/or Facebook account (“Social Accounts”), which is subject to the platform’s official terms and conditions. Posting on Instagram requires a mobile device and therefore message and data rates may apply. If entering via mobile device, your carrier’s network and data charges may apply. Your Social Accounts must be set to “unprotected” and/or “public” for your entries to be viewable by Sponsor. You must continue to follow @wildbasinhardseltzer on your Social Accounts until December 1, 2021 to be notified if you are potential winner.
Approximately 1,500 specially-marked Wild Basin Social Media Sweepstakes Trackables (“Social Media Trackables”), which are in the shape of a can and silver in color, will be given away to individuals who request them between August 3, 2021 to August 10, 2021 (the “Request Period”), with the requirement that the requestors place their Social Media Trackable in geocaches throughout the Eligibility Area. You may refer to Section 5b below for a general description of geocaching. To request a Social Media Trackable, visit www.geocaching.com/wildbasin (the “Promotion Webpage”) and follow the on-screen instructions to request a Social Media Trackable during the Request Period. Each individual who requests a Social Media Trackable through the Promotion Webpage will be required to submit his or her email address, mailing address, and such other information as Sponsor may require. If during the Request Period more than 1,500 individuals request a Social Media Trackable, recipient names will be randomly drawn to determine which requestors will receive the available Social Media Trackables. Individuals selected to receive a Social Media Trackable will have one mailed to them approximately two weeks after the Request Period closes. Individuals who receive a Social Media Trackable, must activate it. To activate the Social Media Trackable, visit www.geocaching.com/track and follow the on-screen instructions or visit the Promotion Webpage, click the “Activate a Trackable” link and follow the on-screen instructions. Following activation, individuals must then place the Social Media Trackable in a geocache for others to find and register that geocache location on www.geocaching.com/wildbasin.
Next, take a photo of yourself with the Social Media Trackable, post the photo to your personal Twitter, Facebook or Instagram account, tag the photo with #WildBasinGetLost #Sweepstakes (hereinafter, a “Photograph”) and tweet/post the Photograph publicly to your Social Account. Tweet/post must include a Photograph that captures the image of the Social Media Trackable and the hashtags #WildBasinGetLost and #Sweepstakes (the “Hashtags”) as specified below to be considered a valid entry submission (your “Submission”). Entrants automatically will receive one (1) entry into the Social Media Sweepstakes for a qualified Submission. Re-Tweets and re-posts will not accrue entries in the Social Media Sweepstakes. There is a limit of one (1) entry in the Social Media Sweepstakes per person, per day. Photo must be shared publicly to be entered in the Social Media Sweepstakes. See below for additional entry requirements. Each entry must be posted no later than 11:59 PM EST on October 31, 2021. Instagram accounts are available as a free download to your web-enabled mobile device via www.instagram.com, and Twitter accounts are available for free at www.twitter.com. Any attempt by a person to use multiple accounts or identities to gain more entries than permitted by these Official Rules shall result in disqualification at the discretion of the judges or Sponsor. Multiple entrants are not permitted to share the same email or social media account. Sponsor is under no obligation to correspond about entries, nor is Sponsor required to acknowledge its receipt of entries. Proof of submission of entry does not constitute proof of receipt of entry. In the event of a dispute as to the identity of the entrant associated with any entry, the authorized account holder of the social media account or email account associated with the entry, at time of submission, will be deemed to be the entrant. The “authorized account holder” is the natural person assigned to the social media account or email account by the applicable social media platform or email provider. Potential winners may be required to show proof of being the authorized account holder. In the event of a dispute regarding the identity of the person who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. In addition to compliance with these Official Rules, participation must also comply with the terms of service of the applicable social media platform (https://twitter.com/tos, and/or www.instagram.com/about/legal/terms, as applicable). Further, note that your entry will not be considered successfully submitted if your social media account settings prevent Sponsor from seeing your entry. Normal Internet access and usage charges imposed by your online service will apply. If you participate from your mobile phone, such activity will be subject to the charges pursuant to your wireless service provider’s rate plan. You further understand that by participating via mobile phone, if you are a potential winner, the Sponsor may contact you via mobile phone, which will be subject to the charges pursuant to your wireless service provider’s rate plan. Please consult your wireless service provider for more information. Entrants are solely responsible for any related equipment and internet access charges, if any.
Posting via Instagram. To post a Photograph via Instagram, you must make a post via Instagram during the Promotion Period that includes the Photograph and the Hashtags in the caption accompanying the Instagram post. You must have your Instagram account privacy settings set to “Off” from the time of posting throughout the remainder of the Promotion Period. Each Instagram post must comply with all terms and conditions and technical requirements of Instagram, including without limitation the Terms of Use and the Community Guidelines. Entrants are prohibited from inaccurately tagging content or encouraging other Instagram users to inaccurately tag content in any Instagram post. A post to an Instagram Story will not be considered a valid entry into this Social Media Sweepstakes.
Posting via Twitter. To post a Photograph via Twitter, you must send a Tweet via Twitter during the Promotion Period that includes the Photograph and the Hashtags. You must have your Twitter account settings set to “unprotected” or “public” from the time of posting throughout the remainder of the Promotion Period and must be able to receive Direct Messages. Each Tweet must comply with all terms and conditions and technical requirements of Twitter, including without limitation the Twitter Terms of Service and the Twitter Rules.
Posting via Facebook. To post a Photograph via Facebook, you must make a post via Facebook during the Promotion Period that includes the Photograph and the Hashtags. You must have your Facebook account privacy settings such that your post can be seen by the public (i.e., anyone on or off Facebook) from the time of submission throughout the remainder of the Entry Period. Each Facebook post must comply with all terms and conditions and technical requirements of Facebook, including without limitation the Statement of Rights and Responsibilities and Community Standards.
You may visit www.geocaching.com/wildbasin during the Promotion Period to see which geocaches may contain a Social Media Trackable (note, however, that the location of Wild Basin Get Lost Trackables which contain a code for participation in the Get Lost Geocaching Treasure Hunt will not be disclosed; see Section 5 for complete details). You should only attempt to locate any Social Media Trackable in a geocache that you feel you can locate safely. Note further that: [a] finding a Social Media Trackable is simply one possible step in the Social Media Sweepstakes entry process, and does not automatically entitle a person to claim a prize of any kind; [b] Social Media Trackables are only part of the Social Media Sweepstakes, and are not part of (and do not have any effect on) the Get Lost Geocaching Treasure Hunt; and [c] if you find a Social Media Trackable, you may take a photo of yourself with it (and may be used to enter the Social Media Sweepstakes as described herein) and then place it back in the geocache where you found it or move it promptly to another geocache. In no event should you keep the Social Media Trackable. If you choose to move a Social Media Trackable to another geocache, you should log the tracking code engraved on the Social Media Trackable at https://www.geocaching.com/track with the location of the new geocache; however note that this tracking activity does not result in an entry into the Social Media Sweepstakes.
After visiting the Promotion Webpage and determining the locations of geocaches in which Social Media Trackables have been deposited during the Promotion Period, visit any of such geocache locations to look for a Social Media Trackable. There is no guarantee that any Social Media Trackables will be available for finding in any location designated by the Promotion Webpage or on Geocaching.com.
4b. ADDITIONAL SOCIAL MEDIA SWEEPSTAKES ENTRY REQUIREMENTS: Any elements that appear in an entry photo must not: (a) include an image of any person that is (or appears to be) under 21 years of age; (b) depict persons consuming alcoholic beverages; (c) depict persons conducting themselves in an inappropriate manner; (d) depict or allude to the overconsumption of alcohol; or (e) contain material that would imply that the consumption of alcoholic beverages is acceptable before or while operating machinery, driving a vehicle or undertaking any other activity that requires a high degree of alertness or physical coordination. Any elements that appear in an entry photo, including, without limitation, brand names, logos, or images, must be either: (a) entirely original, created by the entrant; (b) property of the Sponsor (the “Provided Materials”); or (c) in the public domain. Sponsor grants to entrants a limited revocable, non-sub-licensable license to use the Provided Materials for the sole purpose of creating an entry, if an entrant chooses to do so. Use of Provided Materials is not required for entry, nor will it affect an entrant’s chances of winning. In addition, entrant recognizes that all of the right, title, and interest in the Provided Materials as well as all derivative works created using the Provided Materials (including an entry) shall vest exclusively in Sponsor, and entrant will not have or take any action that might harm or adversely affect such rights. No right, title, or interest in and to the Provided Materials except for the limited license granted to entrant in these Official Rules is transferred or created.
Use of any prohibited elements in an entry photo may result in disqualification of the applicable entry, in the Sponsor’s sole discretion. Entries must not contain the name or logo of any alcohol beverage wholesaler or retailer. Entrants must not engage in any violent, dangerous, or illegal behavior in creating an entry. Entries must not contain inappropriate content, including but not limited to vulgarity, obscenity, lewd, pornographic or violent material, or materials which promote hate or violence. Entries must not defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies. Entries must not defame or invade the privacy or publicity rights of any person, living or deceased, or otherwise infringe upon a person’s personal or proprietary rights. Entries that do not include all required information and do not adhere to the foregoing and following requirements or are deemed to be immoral, obscene, profane or not in keeping with Sponsor’s image (all as determined by Sponsor in its sole discretion) will be considered void.
By participating in the Social Media Sweepstakes, you represent and warrant that: (a) you are the creator of your entry; (b) your entry is wholly original (apart from any allowable public domain elements or elements owned by Sponsor); (c) your entry does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; and (d) your entry has not previously been entered in any other promotion.
By participating in the Social Media Sweepstakes, you further represent and warrant that: (a) you have obtained written permission from each person whose image or likeness is included in the entry; (b) such persons are age 21 or older, and appear to be so; (c) if you are not the person who took the applicable photo, you have obtained written permission from the person who took the applicable photo and such person(s) have granted all necessary rights to use the applicable photo; (d) you can and will give written copies of such permissions to the Sponsor upon request along with proof of age for any such person; and (e) you understand that such documents may be required in order to be deemed a winner. Failure to provide said proof may result in disqualification of the entry from the Social Media Sweepstakes. Sponsor’s determination as to whether any entry potentially violates the rights of any third party is final. Submitting an entry that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you.
By participating in the Social Media Sweepstakes, you grant the Sponsor and its affiliated companies and Groundspeak, Inc. DBA Geocaching (“Groundspeak”) the unconditional (subject only to any applicable rights of Instagram, Facebook or Twitter) and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, edit, adapt, modify, create derivative works of, exhibit, and otherwise use the entry or part thereof (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party. Without limiting the foregoing, Sponsor reserves the right to post an online gallery of entries selected in its sole discretion, or to re-post any entries selected in its sole discretion on Facebook, Instagram, or Twitter. Should Sponsor edit your entry for purposes of re-use, you are not relieved from responsibility for compliance with these Official Rules. You agree that, upon request by the Sponsor, you will sign a copyright assignment. By participating, you further agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties (as defined below), or any other person or entity, on the grounds that any use of the entry, or any derivative works, infringes any of your rights, including, without limitation, copyrights and moral rights. You further acknowledge that, unless specified otherwise herein, the Sponsor is in no way obligated to broadcast, publish or use your entry in any way. Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and the Sponsor. In no way are you to be construed as the agent or to be acting as the agent of the Sponsor.
Alternate Method of Entry: You may enter through an Alternate Method of Entry (the “AMOE”) by mailing a self-addressed, stamped, #10 standard-sized envelope containing one (1) 8 ½” x 11” sheet of paper with your name, shipping address, email address, and phone number to: Wild Basin Geocaching Get Lost Sweepstakes, P.O. Box 1008, Rocky Hill, CT 06067-1008. Mail-in entries must be postmarked between August 3, 2021 and October 31, 2021.
4c. SOCIAL MEDIA SWEEPSTAKES RANDOM DRAWING/PRIZE DESCRIPTION/ODDS: Sponsor will randomly select the winners on or about November 8, 2021 from among all eligible Social Media Sweepstakes entries received during the Promotion Period. Fifty (50) Social Media Sweepstakes winners will receive one (1) Wild Basin Hammock (ARV: $50-$65). The actual ARV and the total retail value of Social Media Sweepstakes prizes may vary. Odds of winning depend on the number of eligible entries received during the Promotion Period. Entry photos will not be judged, and winner determination is not affected by the quality of the photo associated with any eligible entry. See Section 4d below for winner notification details, and Section 6 below for additional prize restrictions Limit one prize per person or household.
4d. SOCIAL MEDIA SWEEPSTAKES WINNER NOTIFICATION: The names of potential winners and/or their social media “handles” may be announced online prior to verification, however any such announcement is not a guarantee of eligibility. The potential winners will be notified via a social media message or comment on the social media platform used to submit the winning entry, or by email, to verify his/her eligibility and ability to accept the prize, and to obtain his/her complete contact information. It is recommended that entrants confirm that their social media notification settings are turned on, such that they would be notified in a timely fashion of an attempt to contact them via the applicable social media platform for this purpose. Any such message, comment, or email will instruct the potential winner to reply within three (3) full business days (measured in the local time zone) after the time that the notification message or comment was sent/posted. Potential winners must reply as instructed to identify him/herself, confirm his/her eligibility and ability to accept the prize, and provide his/her complete contact information within such three (3) full business day period, or he/she will be disqualified. In Sponsor’s sole discretion, a potential winner may only be notified one time as set forth above for attempted prize notification. The potential winner may subsequently be required to complete a declaration of eligibility, a liability release, a copyright assignment, and (where legal) a publicity release, and any other releases or documentation deemed necessary for Sponsor’s intended use of the winning entry, which must be returned within the time period specified by Sponsor at the time of such request. Proof of identity, age, and legal residence (in the form of a copy of government-issued photo identification) may be required to claim a prize. Any winner or potential winner may be disqualified in Sponsor’s sole discretion if: (a) he/she fails to reply or to provide any required information or properly completed documents within the required time period; (b) he/she fails to comply with any of the terms of these Official Rules; or (c) if any prize or prize notification is returned as undeliverable. In the event of disqualification of a winner, at Sponsor’s sole discretion the prize may be awarded to an alternate winner selected from among the remaining applicable eligible entries via the means of winner determination described herein, pending verification of eligibility. If any prize remains unclaimed after three (3) potential winners have been notified for that prize, the prize may remain unawarded, in Sponsor’s sole discretion.
5a. GEOCACHING GENERAL DESCRIPTION AND REGISTRATION: Geocaching is a real-world, outdoor treasure hunting game using GPS-enabled devices. Participants navigate to a specific set of GPS coordinates and then attempt to find the geocache (container) hidden at that location. To prepare for participation in the “Get Lost” Geocaching Treasure Hunt (and, if you wish to attempt to locate a Social Media Trackable for participation in the Social Media Sweepstakes as described above), you must first visit www.geocaching.com and follow the site instructions to create a free account. You may then visit www.geocaching.com/guide to learn more about the geocaching experience and finding your first geocache, and www.geocaching.com/play/search to select geocaches that you wish to attempt to locate.
5b. TO PARTICIPATE IN THE GET LOST GEOCACHING TREASURE HUNT: The Get Lost Geocaching Treasure Hunt is a free treasure hunt activity offered within the states of CA, CO, DC, GA, IL, NJ, NC, PA, TN, TX and UT (collectively, the “Markets”). YOU ARE RESPONSIBLE FOR YOUR OWN TRANSPORT, SAFETY, PREPARATION FOR WEATHER AND ANY OTHER MATTERS ARISING IN YOUR PARTICIPATION IN THE “GET LOST” GEOCACHING TREASURE HUNT. Sponsor will place fifteen (15) winning Wild Basin “Get Lost” Trackables (“Get Lost Trackables”) in fifteen (15) Sponsor-selected geocaches which are randomly located somewhere within the Markets. Note further that the placement of the Get Lost Trackables may occur at any time during the Promotion Period. To participate in the Get Lost Geocaching Treasure Hunt:
(1) Follow @wildbasinhardseltzer on Twitter, Instagram, and/or Facebook;
(2) Have an account on Geocaching.com; to register for an account with Geocaching.com, visit www.geocaching.com/account/register and follow the directions on the website to create a free account,
(3) Use www.geocaching.com to select a geocache within the Markets which you feel you can locate safely; and
(4) Attempt to locate that geocache and check to see if it contains a Get Lost Trackable. If the geocache does not contain a Get Lost Trackable, you have not won a prize in the Get Lost Geocaching Treasure Hunt. If the geocache does contain a Get Lost Trackable (which will contain the words “GET LOST TRACKABLE”, a winning message, and a unique prize code), you may attempt to claim the associated prize by following the instructions in Section 5c below. Get Lost Trackables will be placed in a geocache location; however, finding a Get Lost Trackable does not automatically entitle a person to claim a prize of any kind. For the avoidance of doubt, www.geocaching.com provides information on the location of all registered geocaches, but will not provide any clues regarding which geocaches contain a Get Lost Trackable and which do not. Get Lost Trackables which are found after 11:59 PM ET on October 31, 2021 will be void. Get Lost Trackables are void if not obtained in accordance with these Official Rules, or if any part is forged, illegible, counterfeited, incomplete, mechanically reproduced, photocopied, altered, mutilated or tampered with in any way.
5c. TO CLAIM A PRIZE IN THE “GET LOST” GEOCACHING TREASURE HUNT/PRIZES/ODDS: If you locate a Get Lost Trackable in a geocache, you should remove the Get Lost Trackable from the geocache, and then follow the claim instructions located inside the Get Lost Trackable, including calling the specified toll-free telephone number to announce your intention to claim the prize, take a survey of your eligibility, and receive further instructions on how to claim your prize. All such claims must be received by Sponsor’s prize claim center no later than November 5, 2021. All claims are subject to verification at the sole discretion of Sponsor. Fraud detection devices may be used for verification purposes. Each such potential winner will subsequently be required to complete a notarized affidavit of eligibility, a liability release, and (where legal) a publicity release, which must be returned within the time period specified by Sponsor at the time of such request. Proof of identity, age, and legal residence (in the form of a copy of government-issued photo identification) may be required to claim a prize. Further, each potential winner will also be required to complete and return an IRS W-9 form within the time period specified by Sponsor, and such winner will receive an IRS Form 1099 issued in his/her name for the actual value of prizes received. Any winner or potential winner may be disqualified in Sponsor’s sole discretion if: (a) he/she fails to reply or to provide any required information or properly completed documents within the required time period; (b) he/she fails to comply with any of the terms of these Official Rules; or (c) if any prize or prize notification is returned as undeliverable.
5d. GET LOST GEOCACHING TREASURE HUNT PRIZES/ODDS: Fifteen (15) Grand Prize winners will each receive a cash money gift card for One Thousand Dollars (ARV $1000). For the avoidance of doubt, there are fifteen (15) Get Lost Trackables made available, there will be no more than fifteen (15) Get Lost Geocaching Treasure Hunt winners. Limit two (2) Get Lost Geocaching Treasure Hunt prize claims per person and per household. Odds of winning a prize in the Get Lost Geocaching Treasure Hunt depend on the number of eligible participants in a particular Market, the number of geocaches they check, and other factors.
